Letters of Administration

Where someone is not validly appointed as an executor under a will then there needs to be someone in charge of the estate, an Administrator appointed under Letters of Administration issued from the Court.

There are two instances where Letters of Administration will be necessary:

  • Where someone dies intestate, that is without a will; or
  • Where there is a will but there is no executor who is validly appointed or all executors who were validly appointed renounce.
